Congratulations. You just spent a year living in an old, poorly-maintained apartment with an eerie laundry room and an invisible landlord, and you’re finally moving out. Whether you’ve just graduated, or have already started working at your first full-time job - again, congrats - you’re probably looking forward to moving out, and moving up! Suddenly, you realize you haven’t received your security deposit from your last apartment. Your landlord never sent it to you. In fact, your landlord says they’re keeping it to repair damages, which is new, since you left the place exactly as you found it. It seems like it’s time for you to go to court.


This type of case is usually taken care of in Small Claims Court, a local government institution that allows individuals to file a case under a certain amount (usually around $10,000) and ‘pro se’ (without having to hire a lawyer). The Pros? Well, you just read them. You’re not required to hire a lawyer, you can file a claim for a low amount, and the procedure is supposed to be much faster than the traditional court system. But, there are quite a few Cons as well.

Claiming that security deposit through Small Claims Court is a lot of work: before you even get to court, you’ll need to do your research to understand what you’re getting into, file the right claim, pay court and administrative fees (which usually amount to hundreds of dollars), gather evidence, make copies of the evidence for the court, and wait for your hearing (which can take months). And even if you win your case, you aren’t guaranteed to receive the money you are owed, because that’s a whole different bag of worms.
